Messages - Baron Alexandreu Davinescu

You can imagine all kinds of stuff, I guess?  But the post says very clearly that she just started a thread attacking the king, and that this attack is to distract from criticism of the Government.  She's asking for others to pile on, to make it a bigger distraction.

This screenshot comes straight from the Seneschal, so we know it's real.  He started a thread specifically to post this.  Miestra isn't challenging their authenticity -- she's admitting that it's real, too.

I just reread this... So even as far back as seven years ago (that's a long time to be running Talossa, by the way!), criticism of the king has been literally to "help distract from AD's criticism of government performance"?!??!  Like that was actually the plan -- hey, come criticize the monarchy, we need to distract the people?!

I am definitely saving that screenshot!

I'm not sure it's a surprise to anyone that Dama Miestra has been fixated on this for years.  I think it's just sad that this monomania has now extended to the whole exhausted FDT, which after six years of political power has nothing more to offer than a singular obsession, powered by imagined slights from the future.

But I marvel at the fact that we're right back to this.

After a disaster of a term that even you folks admitted was a threat to our country's very survival, the FDT tried to impose a legislative blockade, clumsily attempting to extort an outcome through threats.  The effort was a disaster, making it impossible to actually work on the issue.  They eventually just collapsed the whole thing.

Ironically, backing away from the Same Old Fight actually allowed real legislation on the issue to begin to emerge, a basis on which we can hopefully build in the future.  The nation settled down into a working relationship without acrimony and with a firm but cordial Opposition that kept this Government accountable.  Did anyone really miss the negative politics and ludicrous blockade?  Nope!

Talossa has been a much better place these past few months.  People are actually doing stuff and becoming involved, and we're making a slight turnaround from the precipitous FDT plunge we'd all been enduring.  And you want not only to get back at the Same Old Fight, but it's become the only idea that the FDT has to offer: "Hey Talossa, we're upset that His Majesty is only as active as our own leader."

No matter who wins the election, shouldn't we prefer having fun and enjoying being Talossan?  Is this so important that you're going to get right back into grinding the country down until the ragged bones suit your preferences?  ¿N'estás-c'e?

The TNC wants to have fun doing Talossan stuff, and make it possible for more people to do fun Talossan stuff.  Learn more here:

We discussed it, and it might be possible.  We'll PM you.

Quote from: Miestră Schivă, UrN on January 03, 2023, 03:02:21 PMThat second one! It sounds funnier.

I'm not sure I want a Talossan who has been stalking or sexually harassing another Talossan, as an example, to be able to evade justice.  This law will be a lot less cute and funny if someone does something grotesque and then gets to hang around because of an enabling system.

Quote from: Miestră Schivă, UrN on January 03, 2023, 03:02:21 PMSeriously, I can't believe we're in a position where I'm the one arguing against you against abolishing a quirky Talossan tradition. It's usually the other way around.
It's a minor provision in the law that's never been used that originates in a bill that was clearly intended to be a messaging bill.  I didn't cut it from the legal code when I was putting together el Lexhatx because I tried to include literally everything I could to avoid any potential fights.

Quote from: Miestră Schivă, UrN on January 03, 2023, 03:00:42 PMYou keep going on at me about how passing laws means nothing for real Talossan activity. Well: handing out miéida da toro "licences" means nothing either. Pointless.

I'm old enough to remember precisely this same debate in Penguinea, more than 20 years ago. The argument was that handing out licences would encourage Talossan enterprises to flourish. No, it didn't. "Legal backing" means absolutely nothing. It's just busywork.
I mean, woe, woe upon the poor, exhausted official who must hit CTRL+C and then CTRL+V one or possibly even two times a year, am I right?

I know that the Register of Talossan Enterprises was your idea, years ago, but my proposal is definitely not more work... in both cases, people submit stuff and it's posted publicly.  My proposal just also allows people to build up a legal structure that can be binding, too.  It's almost the same amount of work.

People actually did this, though. They were actually interested.  I had a license.  MPF had a license.  And this provides a vehicle to start to build institutions that extend beyond personal networks and have legal backing!

The current law is emphatically not working.  The Register of Talossan Enterprises doesn't exist and never has!

Quote from: Miestră Schivă, UrN on January 03, 2023, 02:33:33 PMThe right to sanctuary is a time-honoured one.
And what does it mean in a Talossan context?  Does it mean that I can break the law and then say that I'm claiming sanctuary from Talossans United in Christ or some other religion, and therefore I can't be prosecuted?  Or do I have to go a church physically and take a picture that I'm in there, and then I can do some more crimes?

Side note: while I appreciate your idea, Dama Miestra, I again have to say that I am not comfortable removing the ennumeration of the Ziu's powers.  It would be a drastic expansion of government power, and any such change should be considered in isolation and carefully.

Quote from: Baron Alexandreu Davinescu on May 31, 2022, 01:28:04 PMWHEREAS currently the entire status of much of our legal system is possibly itself illegal, since the Ziu's ennumerated powers do not include any power to write criminal laws at all, nor to regulate any aspect of the legal system, meaning that most of Titles A & J are very much in doubt if challenged in cort, and

WHEREAS this means that basically none of our criminal laws or rules about the cort system actually work, and

WHEREAS currently there does not appear to be any sunset on appeals, so something can be appeal even after ten years, and that's not okay, and

WHEREAS we have a law permitting sanctuary on the books, even though it's extremely unclear how that could possibly work,

PART ONE: LEGAL OVERSIGHT

THEREFORE the third section of Article VII of the 1997 Organic Law shall be amended to include these additional provisions:

Quote20. Criminal justice designed to protect the personal and property rights of citizens.
21. Administrative matters incidental to the functioning of the justice system.

PART TWO: APPEALS

FURTHERMORE a new provision shall be inserted in the first subsection of the third section of Title G of el Lexhatx, reading

Quote3.1.1 There is a 90-day statute of limitations on all judicial appeals.

FURTHERMORE, the Scribe is directed to renumber the third section of Title G in a sensible fashion.

Uréu q'estadra så:
Baron Alexandreu Davinescu
I am dropping the third provision and keeping it separate, but intend to keep working on this bill with a few other legal bits and bobs that have come up in my time as Clerk of Corts, after consulting with V further.

Last term, this bill was blocked due to the Government legislative blockade.  Legally, I was thus barred from reintroducing it during the same session.  I intend to reintroduce it in the coming term.  The bill will be nearly identical -- I don't think it needs any significant changes.

Just bumping this, since I saw GV posting recently (campaign season, when so many folks start chatting again :) !).  Not really sure what else to do -- seems too important to just assume that the archive works and risk losing the entire contents of old Wittenberg.
