A PROCLAMATION OF THE JUNE 2021 ELECTION FOR L'ETATS DE CÉZEMBRE

This information adjusts and replaces the previous preliminary notice of election sent 16 May, and will again be also sent via electronic mail.  There may be subsequent adjustment, either by those approving the ratification, or if there is any change in the post of Sénéchal, or if there are others wishing to appeal to the Cort with time to avoid any emergency injunctions

As Le Sénéchal I shall conduct the upcoming election for l'Etats de Cézembre according to existing law, and the administrative authority vested in this office.  I have invoked Article 8 of the constitution to hold local elections, and am updating the previous proper notice both in this forum and via email.  Cézembre election law is found within the constitution and various amendments quoted for reference after this proclamation.

There is no specific l'Etats election act, but there are procedures established in subsequent Sénéchal and Lord Warden election acts that will be adopted as administrative procedures for this election.

As to authority to act

1.    Until such time as there is another candidate for Le Sénéchal, I shall continue in office and there shall be no election for Le Sénéchal following the procedure of the Lord Warden election act enacted subsequent to the Sénéchal election act and establishes Cézembre election procedure and which states "no election will be held and the sole candidate will be considered elected to the position." should I remain the sole candidate as the existing officer.

2.   Should there be another candidate for Le Sénéchal, I would immediately withdraw my candidacy for continuance in that office, and should that person remain the only candidate, then they would be elected in a similar manner.  I offer to become the conducting officer for the election of l'Etats if desired by the new Sénéchal, or that person could assume that duty, or that person could decide to ask the Chancery to conduct the election.

3.   Should there be more than one candidate for Le Sénéchal other than myself, I would again immediately withdraw my candidacy for continuance in that office, but would continue as the conducting official of the election of the new Sénéchal as well as l'Etats.

Should my authority to act proceed, then I proclaim that the election for l'Etats shall proceed by nomination by name of any Cézembre citizen to serve in l'Etats.   Those citizens named as candidates may identify with no party, or one party, or multiple parties as they wish, however, votes shall be cast only for the name listed on the ballot which must be declared in the nomination period defined in the first week of the election period, with voting taking place in the second and third week of the election period.  These can be self nominations, or nominations by Cézembre citizens of other Cézembre citizens who subsequently affirm their intent to stand for election within the nomination period.

again wish to stand for the office.  Others may declare their intent to stand on or before June 14 19:30 TST (June 15 at 0230 CZT), such that ballots may be prepared.  A "Sticky Slate" Amendment will be discussed in l'Etats to formalize this concept in the session leading up to the election period and may, along with other referenda, have potential to be offered to the citizenry for approval.

In the past, including the most recent election (conducted by the Chancery), there were issues of potential confusion between votes for parties and votes for persons, which were subsequently combined for purposes of allocation of seats within l'Etats.  There were also issues with rules that the Chancery must follow regarding write in votes which are not part of Cézembre law which result in vacant seats due to the lack of a representative of a party for those votes cast.

The times of the election based upon the constitution and the existing Chancery election to the Ziu shall establish the first week of nominations on June 7 at 19:30 TST (June 8 at 0230 CZT) to June 14 19:30 TST (June 15 at 0230 CZT) and the election June 14 – June 28 19:30 TST (June 29 at 0230 CZT).  Candidates are encouraged to make their self-nominations known even prior to the election, and as early as possible within the nomination period to assist in the balloting process.  Those who nominate someone else should communicate their wishes to the nominee such that the candidate may affirm their standing within the nomination period.

The election will take place in an official voting thread, or via the electionbuddy.com system which has been tested and found satisfactory and conformant to the requirements of the constitution, or via email, or telephone, or postal mail as any individual Cézembre citizen may desire when the official ballot is issued. (Note: electionbuddy can be used without cost for up to 20 voters, and the current population of Cézembre is 21, however, as whether or not I remain Sénéchal I will vote in public as I have always done, thus providing for a secret ballot - if desired - for all other citizens)

Those who wish to raise questions with this proclamation are advised to bring said questions to this thread before the end of the nomination period.  This will be the place for any adjustment of the process, however, those not satisfied may seek relief via Cort Pü Inalt as per Article 19 & 20 of the CAG.  This proclamation, after ratification by the Governor-General also will be sent via email to those who do not participate in these forums for response.

Constitution of the Sovereign Province of Cézembre
From Article 1.  ...Cézembre is an autonomous and self-governing...

From Article 7. ...l'Etats shall consist of no more and no less than twenty (20) seats.
Seats in l'Etats de Cézembre can only be assigned to citizens of Cézembre. Citizens may hold more than one seat, but no more than six. One seat cannot be divided among nor assigned to more than one citizen.

From Article 8 ... The Sénéchal (or the Governor-General in case the Sénéchal has been absent
for more than one week) may request the chancery not to conduct those elections in no less than one week before balloting day. If the Sénéchal (or Governor-General) makes such a request, the Sénéchal (or the Governor-General) shall conduct the elections in accordance with provincial election laws and rules.

Article 11. Le Sénéchal shall be the elected leader of Cezembre. Le Sénéchal shall have the power to issue proclamations which have the force of law. These proclamations may be appealed or amended as regular laws. These proclamations may not act as acts of attainders or any activity prohibited by the Organic Law (with regards to Prime Dictats). These proclamations must be counter-signed by the Governor-General (or the King, in case of, by lack of appointment or by long-term absence, a Governor-General).

Article 14. Elections as described by article 10 will take, no less and no longer than 3 weeks. Cézembrians must announce their candidacy in the first week of the election and polls shall open on the first day of the 2nd week and close on the last day of the third week.

Article 15. Elections, as described in articles 10 and 11 will start no earlier than one week and no later than two weeks after the election deadline of Talossan general elections or after a resolution has been approved by a majority of the l'Etats de Cézembre removing the previous
Sénéchal or should the Sénéchal, resign, die or be unable to fulfill his duties for any reason.

A8: The Sénéchal Elections Act

6. Before the start of the nomination phase the Conducting Officer will send all voters an email explaining the election procedures. This message must be posted online as well to ensure voters who did not receive the email have the chance to notify the Conducting Officer of the mistake, so it can be fixed.

A9: The 51st Cosa Lord Warden Election Act

8. The election will be conducted using Ballotbin or a similar automated ballot that is capable of conducting the elections in accordance with the provisions of this act.

9. The settings of the Bin must be so that the Admins can only see the results after the election, the candidates are presented in random order and the election is conducted using a preferential vote.

15. If there is one sole candidate for the position of Lord Warden at the start of the election, no election will be held and the sole candidate will be considered elected to the position.
(note this does not appear in the Sénéchal Elections Act but was enacted later and thus establishes local election procedures)

In detailed reading of the CAG, there need to be a followup to the announcement of the Cézembre election notification sent by email on 16 May, and that adjustment by email will take place on or before 1 June to be compliant with the Cézembre electon process.  As per CAG arrticle 14, nominations take place the week of June 7-13, with the election running June 14-28 (not 30 as previously proposed). The following amendment if passed by l'Etats by June 13 would then be sent for ratification by the electorate during this election to be implemented for the following election just after that for the 57th Ziu.

The Cezembre Administration Guide specifies when Cezembre conducts an election, and

It is desireable to have the option to retain effective legislators, and

There can be logistical challenges when Cezembre elections are held by statute no earlier than one week nor no later than two weeks after the general election of the Ziu, and

BE IT RESOLVED that
All seated l'Etats members shall be placed on the ballot for the next session of l'Etats, unless they specifically request not to be listed along with others who declare their candidacy.

This process only establishes the slate of candidates -- if a candidate does not receive any votes, they would not enter into the apportionment specified in CAG Article 9.

7 of 21 Cézembre citizens have voted in the election for the Ziu thus far, which may also be a most of those who are registered on these forums.  If you have personal connections to encourage greater participation please do so as my hands appear tied to only promotion of the Cézembre election for which I have already sent one message (mentioning also the current election) and the next message will be to describe the successful test of the electionbuddy system as well as to make a second call for l'Etats & Seneshal candidates.  However, that won't happen until after the election of the Ziu is complete.

To the Civil Service,

While talossa.proboards.com has been retired, might it be possible for one posting to be placed there about the current election and again to encourage joining these forums as only about half the electorate has registered here some 18 months after changeover?

I am not currently a seated member in the Ziu, but have a suggestion for consideration - the creation of a Political Parties forum under the Special Interests area, and to have child boards under established under that for each party (perhaps even for past parties that wish to have a historic listing although their last statements may have been on the talossa.proboards.com system or even just in email or printed materials)

This is addition to parties or persons supporting those parties commenting on whatever posting they wish in other forums, but could serve as a point to examine details in an organized manner.

7.3. No Talossan citizen may transfer his provincial citizenship to a different province, except by physically moving into that province or into the zone corresponding to that province. A citizens living inside or outside of Talossa, who moves permanently into an outside zone corresponding to a different province will be (re)assigned by the SoS to the province corresponding to the new geographic zone in accordance with the following provisions:
7.3.1 The provisions in this section do not apply unless the citizen explicitly consents to being reassigned. Whenever any Talossan wants to move his provincial assignment to the province in whose assigned area he actually lives, he may do so by notifying the Chancery. Cézembre homestead holders who are not citizens Cézembre should still have their voices heard by l'Etats and the government of Cézembre

Be it resolved that

There shall be a CÉZEMBRE HOMESTEAD ASSOCIATION (CHA) created such that the CHA may provide non-binding yet formalized advice to l'Etats and the government of Cézembre, and to otherwise assist the CLO in organization of the homesteading effort including the election of officers to represent the CHA and the creation of by-laws for the CHA.

Breton is also the name of the language of the Breton people, and

The sole historic and national language of the entire Talossan people, and therefore of the Cézembrian Province, is the Talossan language (el glhetg Talossan).
The Cézembrian government shall also recognise English and French as useful working second languages, and may adopt tertiary working languages by law.

Be it resolved that

The Cézembrian government shall recognize Breton as a tertiary working language.

There may be legislation to be considered and/or referred by l'Etats to the citizens for the upcoming Cézembre election taking place June 14-July 1, along with ratification of the updated CAG based upon enacted legislation.

You are invited to join the Balançeu / Balance party if you have interest in retaining the current monarchy for Talossa that changes only under occasional and extraordinary circumstances. The current system has worked for over 40 years. Balançeu / Balance believes there should not be a change to an elected office called "King" similar to a President (such as occurs in 12 other global countries such as Armenia, Azerbaijan, Burundi, Cameroon, Equatorial Guinea, Gabon, Ireland, Israel, Italy, Syria, and Tajikistan every 7 years).

Several other parties support 55RZ21 The Talossa Shall Choose Its King Amendment. Balançeu / Balance party does not support that legislation as Talossa already has a King, and in the future may have a different King or Queen through existing traditions.

In general, the Balançeu / Balance party supports the combination of an elected Ziu (Cosa and Senäts) balanced with a Monarchy which is not subject to the vagaries of periodic elections. A King or Queen who operates as a Chief Executive Officer, who may delegate tasks as he or she sees fit, and takes a long view of events and circumstances beyond that of ephemeral political arguement.

If you support Balançeu / Balance in the election, you are also invited to join the party LIST such that your voice can be heard directly within the Cosa. Just write your name in the thread https://talossa.net/members/xpb/activity/439/#acomment-440 such that one or more seats granted in the election may be yours to represent, depending upon the number of ballots cast for Balançeu / Balance. As per Lex B.2.3 The ballot must also include, for each party contesting the election, a list of citizens to whom the party intends to award Cosa seats.

Alternatively you can call or text message 414-253-3643 (41-HALF-DOGE) or you can send email to balanceubalance@gmail.com. As per rules posted for the current election cycle, you need to make your intention to join the party list known prior to 13 May 23:59 TST (-5 UTC) – and preferably much earlier to aid the administration of the election. This information becomes public knowledge as part of the ballot, but throughout the balloting process you as a matter of course retain the right to vote as you choose without regard to being listed.

One may note a flurry of constitutional amendments and other legislation happening in other locations.  My interpretation is that current Cézembre statutes do not provide adequate notice prior to the general election for the Cosa (conducted by the Chancery) and for the Lord Warden (conducted by Cézembre) for amendments.  There is adequate time, however, to consider legislation to be referred by l'Etats to the citizens of Cézembre for the upcoming Cézembre election taking place June 14-July 1.  I call for a session of l'Etats June 2-13 for consideration of those potential bills, which in turn will be informed by the polls conducted in the realm prior to that date.

Both have great vitality, and are clever beings of their own devices, wild and free, yet come together to support the Kingdom, and can be envisioned as the Cosa and Senäts.

Now consider the Royal Arms which include Quarterly 2 and 3 per fess azure and vert, a wolf salient argent armed and langued gules

This element is wise, as there are two wolves fighting in each person's heart. One is love, the other is hate. Which one wins?  The one that is fed the most.

There are those who hate the idea of a King or Queen unbound and free to direct the course of our history with greatly appreciated support.  They hate that the vagaries of time and events include only unscheduled and occasional change to the leader of the pack.  They desire to domesticate the wolf, to change it into a chihuahua that they can stuff in a bag or kennel when desired, or simply drop off at a shelter (or worse) when they want a different one.  They in fact want to change themselves from squirrels to hamsters in a cage of their own design, running on wheels of circular logic, declaring a chihuahua to be a wolf, asserting their own independence whilst residing behind bars.

On 26 December 1979 King Ben lovingly created the Kingdom of Talossa.  He wrestled with the wolves, and from time to time fed the hate.  However, the creation endures over 4 decades later, bourne out of the love of the citizens for the Kingdom.  The Kingdom even attracted back those who had left for a time with loving arms.  Yet, some of those same citizens still nurture hate of the crown and seek to obfuscate their desired change to a Republic -- with false flags, logistical legerdemain, and other schemes to tame what is wild and free, and which shall endure on natural fate rather than mechanism.

As Le Sénéchal (unless removed from office as part of Article 15) I declare that all candidates for l'Etats shall declare their intent IN THIS THREAD on or before 12 June 2021 at 23:59 (was 13 June, modified to give a day to get the ballot together), with an election taking place from 14 June 00:00 to 30 June at 23:59 deadline with results declared on 1 July 2021.

I hereby declare my candidacy for the position of Le Sénéchal, to which I was previously appointed.  Should one other citizen of Cézembre declare, before 13 June at 23:59 their same intent IN THIS THREAD to stand for the position of Le Sénéchal then I will immediately withdraw my candidacy, and they shall be elected, much in the manner of the Lord Warden.  Should more than one citizen of Cézembre other than myself declare their candidacy, I will volunteer to conduct that election as I would still withdraw as a candidate after the first declaration.

RAK = shortened form of the Breton raktresoù-lezenn, as a method to list proposed legislation, projet de loi, proxhet for the CAG ( CÉZEMBREAN ADMINISTRATION GUIDE )

To "put something on the RAK" will be to introduce items for discussion prior to posting and decision in sessions of l'Etats, similar to the hopper for the Ziu, and where some such RAK may also rise to the level of referral by l'Etats for a poll of all Cézembreans.
