Title: Electing a Premieir - 62nd Cosa

Under the provisions of 59CL1, which states:

QuoteNominations for Premieir shall be opened by the current Premieir within one month of every National Election. Nomination periods shall be two weeks. The election for Premieir shall commence immediately upon the end of the nomination period. Elections for Premieir shall remain open for a period of two weeks.

FURTHERMORE, Should no candidate gain a majority of the votes, the current Premieir shall remain in office until the end of the Cosa term when new elections shall be called.

Therefore, as current Premieir of Maricopa, I now call for nominations for the next Premieir!

Nominations for Premieir shall remain open until 7:30PM TST on December 4, 2025.

Is there any bar on dual offices in Maricopa / Talossa now?

If not, then I'd like to nominate myself for the post.

However, I seriously need to brush up on my Talossan laws again.

Article 13 of the Constitution of Maricopa: So that no conflict of interest may occur, or that no one individual may take over the province in a hostile attempt, no-one may hold any more than one of the offices of Premieir, Governadeir-Xheneral, or Domnul-Senätsesc simultaneously, without express consent of the Cleivi.

You can't be both the Premier and the Senator or be the King's Cunstaval unless the Cabana says it's ok.

I regret my choice of words. Otherwise, the nomination would have been valid till atleast December 15th.

The appointment is bad in law without giving the opportunity to the Cabana to decide on the nomination. The Law does not enforce a blanket ban.

I don't see how Article 1.6 (https://wiki.talossa.com/Constitution_of_the_Sovereign_Province_of_Maricopa#Distribution_of_Power) of the Maricopa constitution is not a blanket ban, but I'm also no lawyer.

With that being said, I have no problem kicking the nomination of @Béneditsch Ardpresteir over to the Cabana to decide.

I thought BenArd was talking about your nomination not getting a vote. Our laws do indeed bar him from being Premieir.

Carlüs Éovart Vilaçafat's final declaration early this month was not valid on two counts -

First, I wasn't disqualified for election in Maricopa, before the Senate votes were verified by the Election Commission, and the fees being paid for taking up the Senate Seat which occured much later, after many a days. So, its my pleasure to say that the Maricopan Parliamentarian and the King of the Nation was wrong in his understanding of the law as it stands.

Second, since there were two candidates in the fray at that point of time, there should have been a vote. Maybe during the process I would have withdrawn, or maybe I could have withdrawn from the Senate race, but the present Maricopan Provincial Head didn't leave me with many options.

However, at present, the discussion is moot, but it may be a point that may be taken heed of in future elections, or the laws may be modified/ amended to take care of such circumstances in the future.

All fair points, BenArd! I didn't take into consideration the overlap of national election certifications and deadlines.

I do think this is an opportunity for legislation, or at least a Premier with more than a tenuous grasp of election law and it's application 😅
