The Clerk of the Corts Hat Restriction Act

WHEREAS under current arrangements the Attorney-General can simultaneously hold the position of Clerk of the Corts;

AND WHEREAS under same current arrangements a Deputy Clerk of the Corts cannot be appointed if s/he also hold the portfolio of Attorney General or Minister of Justice, due to the nature of these duties;

AND WHEREAS due to the nature of these duties it makes sense to also extend this prohibition to the Clerk of the Cort and not just their Deputies;

AND WHEREAS there is some duplication in 2 sections regarding Deputies that needs tidying up;

THEREFORE BE IT ENACTED by the King, Cosâ and Senäts of Talossa in Ziu assembled as follows:

Section 4.8 of El Lexhatx G. Justice, which currently reads:

"The individual holding the office of Clerk of the Corts shall enjoy immunity from civil or criminal suit for any actions performed in the course of his or her official duties while holding this office. This immunity shall be lost upon leaving office. Due to the nature of the Clerk's responsibilities, an individual may not hold the office of Clerk of the Corts, or any deputy thereunder, while simultaneously holding office as a Justice[638] of the Uppermost Cort or any national inferior court."

Shall be amended to read as follows:

"4.8. The individual holding the office of Clerk of the Corts shall enjoy immunity from civil or criminal suit for any actions performed in the course of his or her official duties while holding this office. This immunity shall be lost upon leaving office. Due to the nature of the Clerk's responsibilities, an individual may not hold the office of Clerk of the Corts, or any deputy thereunder, while simultaneously holding office as a Justice of the Uppermost Cort or any national inferior court or the portfolio of Attorney General or Minister of Justice."

Furthermore, Section 5.4 of El Lexhatx G. Justice, which currently reads:

"5.4. Due to the nature of these duties, no deputy shall be appointed who is seated on the bench of the Uppermost Cort or any inferior cort. Nor shall any appointee hold the portfolio of Attorney General or Minister of Justice."

Is hereby repealed in full.

It was - in 2019 the European Parliament voted to end Daylight Savings Time, and a deadline of March 2021 was set, responsibility for negotiating the specifics passed to individual EU member states at Council level. In order for the proposal to be adopted, it must receive a qualified majority of votes at the EU Council. To attain a qualified majority, the proposal must get the votes of 55% of member states, representing 65% of the EU population. 
 
Evidently, the deadline was missed, and progress on the abolition of daylight savings time has stalled due to a lack of consensus among EU member states and a number of more pressing concerns in that time, including Brexit, Covid-19 and the invasion of Ukraine.

So for now plans to get rid of Daylight Savings Time have been indefinitely shelved.

I would suggest that we open up the definition of 7.3.1 and of the person(s) U18, to not be exclusively Talossan Citizens (or Talossans U18 - as Talossan Citizen, arguably has a more limited & defined definition and excludes, for example perspectives). I am of the viewpoint that when it comes to protecting minors, we shouldn't allow for any 'loophole' to exist in our laws. 
Additionally, the most recent cases have been committed by Talossans against non-Talossans. 

My suggested amendment would be:   


Quote7.3.1. Whoever commits physical or sexual violence or threats thereof against any person or "judicial person" under Talossan law is guilty of a felony.
7.3.1.1. "Sexual violence" shall include abuse of trust, where a Talossan citizen over the age of 18 initiates sexual conduct (physically or by means of words or images) with any person under the age of 18; and the citizen over 18 is in a position of supervision, authority or tutelage over said person under 18.

I think you'd be welcome to privately suggest to John he should consider reviving Cunstavals on his own accord, much like you/he did with the Privy Council, in which case this bill would be entirely moot :)

(Of course, the important matter is that the Privy Council is only useful to him, while Cunstavals (should) perform important Organic functions in their own provinces.)

He actually must have been reading this stuff or heard about it, even though I've been scrambling with too much other stuff to bug him, since he emailed me a couple of nights ago and mentioned his intention to appoint some new cunstavais.  The basic problem is 100% correct: we should have active cunstavais.  They're one of those things like the Senate Committee on Rules and Administration that just gets overlooked when it comes to regular maintenance and attention, since they don't see that much action. 

Really, it's on Txec and I, who should be more on-the-ball about it... monitoring and recommending appointments like that are one of the jobs we're supposed to be doing!  The Sabor should maybe get slightly bigger, though, since Txec and I both already have a ton of stuff going on in Talossa.  When I first took the position, I wasn't anticipating returning to partisan politics.

I do think there might be good stuff here in this bill and changes we might want to make, though, Luc.  I'm going to take XPB's suggestion for now and just agree to disagree for the moment, but this general topic is something we should come back to.
One idea might be to have some Guaïrs that are ex officio examples being some of the following:  PM, Leader of the Opposition, SoS, Túischac'h, Mençei, Senior Justice/Justices, Constables etc...

For the record (just so anyone doesn't think I'm ignoring the above), I was removed as Constable of Florencia back in July 2019 by King John and the Crown assumed back the duties of that office.

Therefore I am unable to act on the above. 

I have been in contact with King John regarding the above and I am sure he'll respond in due course.
