To be considered prior to, but at the lastest during the upcoming legislative session beginning 13 January 2021 by l'Etats de Cézembre for amendment and final reading and vote on or before 20 January 2021.  All interested parties may comment upon this draft act.

DRAFT of An Act to secure Homesteads on the Isle of Cézembre

Section 1: Be it enacted by the l'Etats de Cézembre assembled, That any person who is of Talossan or Berber heritage, or who has arrived at the age of twenty-one years, and is a citizen of Talossa, or who shall have filed their declaration of intention to become such, as required by the naturalization laws of the Kingdom of Talossa, and who has never borne arms against the Kingdom of Cézembre or the Kingdom of Talossa or given aid and comfort to its enemies, shall, from and after the nineteeth of January, two thousand and twenty-one, be entitled to a virtual area of three meters by three meters (hereinafter the "Core") as defined be three words as described at https://what3words.com/about-us/, in either the English or French Language, plus the eight 3m^2 areas immediately adjacent the core (hereinafter the core plus the additional 8 areas are the "Site"), from lands in Zone Interdite, upon which said person has filed a written claim in an appropriate thread within a designated forum of http://wittenberg.talossa.com/.  The three words of the Core will be used to identify the Site area.  An area of 16 3m^2 areas surrounding a claim are held as an Easement for egress (which may be shared between Sites). Exceptions to the Site area and Easement include when all senior claims established by date accept a junior claim that would otherwise impinge on one or more senior claims or easements, such that egress to each Site is preserved and a written distribution of 3m^2 areas are ascribed to specific Site claims such that no Site shall have more than nine 3m^2 areas, but may have less. As Cézembre has ready access to the sea, the sea in turn may be used as an Easement for egress.

Section 2. And be it further enacted, That the person applying for the benefit of this act shall, upon application to the register of the Cézembre land office in which he or she is about to make such entry, make affidavit before the said register or receiver that he or she is twenty-one years or more of age, or shall have performed service in the army or navy of the Talossa, and that he has never borne arms against the Government of the the Kingdom of Cézembre or the Kingdom of Talossa or given aid and comfort to its enemies, and that such application is made for his or her exclusive use and benefit, and that said entry is made for the purpose of virtual settlement or occupancy, and not either directly or indirectly for the use or benefit of any other person or persons whomsoever; and upon filing the said affidavit with the register or receiver; Provided, however, That no certificate shall be given or patent issued therefor until the expiration of three months from the date of such entry ; and if, at the expiration of such time, or at any time within two years thereafter, the person making such entry ; or, if he or she be dead, their heirs or devisee; shall. prove by two credible witnesses that he, she, or they have virtually settled or occupied the same for the term of three months immediately succeeding the time of filing the affidavit aforesaid, and shall make affidavit that no part of said land has been alienated, and that he or has borne rue allegiance to Kingdom of Cézembre and the Kingdom of Talossa ; then, in such case, he, she, or they, if at that time a citizen of the Kingdom of Cézembre and/or the Kingdom of Talossa, shall be entitled to a patent, as in other cases provided for by law.

Section 3. And be it further enacted, That the register of the Cézembre land office shall note all such applications on the tract books and plats of that office, and keep a register of all such entries, together with the proof upon which they have been founded.

Section 4. And be it further enacted, That no lands acquired under the provisions of this act shall in any event become liable to the satisfaction of any debt or debts contracted prior to the issuing of the patent therefor.

Section 5. And be it further enacted, That if, at any time after the filing of the affidavit, as required in the second section of this act, and before the expiration of the three months aforesaid, it shall be proven, after due notice to the settler, to the satisfaction of the register of the land office, that the person having filed such affidavit shall have actually changed his or her residence, or abandoned the said land for more than six months at any time, then and in that event the land so entered shall revert to the government.

Section. 6. And be it further enacted, That no individual shall be permitted to acquire title to more than one core area under the provisions of this act; and that the Commissioner of the Cézembre Land Office is hereby required to prepare and issue such rules and regulations, consistent with this act, as shall be necessary and proper to carry its provisions into effect: Provided, That nothing contained in this act shall be so construed as to impair or interfere in any manner whatever with existing preemption rights : And provided, further, That all persons who may have filed their applications for a preemption right prior to the passage of this act, shall be entitled to all privileges of this act: Provided, further, That no person who has served, or may hereafter serve, for a period of not less than fourteen days in the army or navy of the Kingdom of Talossa, either regular or volunteer, under the laws thereof, during the existence of an actual war, domestic or foreign, shall be deprived of the benefits of this act on account of not having attained the age of twenty-one years.

UNDER DISCUSSION

In celebration of Independence Day, Boxing Day, and the first day of Kwanzaa in 2020 which focuses on Umoja (Unity), as an Executive Order as Le Sénéchal Cézembre be it known that:

ALL Talossans may select their own 3 meter square (approximately 10x10 feet) area within the Zone Intredite for their homestead or vacation homestead.  Such areas are know by a three word designation within the What3Words system. 

It is requested of interested Talossans to make a selection prior to Landmark Day which is also Martin Luther King day in the USA, and in 2021 is the day before Remembrance Day in order to be entered into the initial homesteading act.

Procedure:  Visit W3W via this link https://w3w.co/democracies.twigs.escaping which is in the general area north of the Zone Autorisee which runs diagonal from southwest to north east on our fair isle north of this point.  In the lower lefthand portion of the screen you will see a circular control to bring up imagery, and there are typical zoom and pan functions for you to wander around to find a site that is pleasing to you both spatially and in the words that describe it.  Once you have made a selection, copy the link into this thread as a comment.  Claim for any specific 3m^2 area shall be by first posting, however, there are discussions for reciprocal consulates that may take priority.

You may use https://twcc.fr/ to convert W3W into a variety of other coordinate systems.  W3W can be addressed in a variety of languages, and there will be investigation of how to add the French language to the homestead definitions.

An initial homestead act will be entered into discussion with l'Etats de Cézembre beginning the day after Remembrance day to establish procedures for documenting these locations within Cézembre .

As Sénéchal de Cézembre, I request permission to establish a Cézembre Consulate in Vuode.  The best location for this office would appear to be at Bartolotta's Lake Park Bistro in Cononation Park, in the canton of Dun Cestour.  This location would support information sessions for Talossans interested in visiting our fair isle, and to conduct such business as may be appropriate between our lands, and in turn the restaurant would provide fuel to sustain these activities.

As Le Sénéchal I call to order l'Etats de Cézembre the first session within the timeframe of the 55th National Cosa term beginning 1 December 2020.  Let all citizens avail themselves of discussion with the members l'Etats for the purposes of proposing legislation to benefit the entire Provinçu Soveran da Cézembre.

The following members are recognized based upon http://wittenberg.talossa.com/index.php?topic=437.0 and based upon the most recent CÉZEMBREAN ADMINISTRATION GUIDE Version 52.1 of 22 October, 2018 (hereinafter the "CAG") found at https://www.dropbox.com/s/ionhjfgbd73mbnn/CezAdmGuide-52.1.pdf?dl=0 where the calculations by Glüc da Dhi S.H. determined that:

@Txosuè Éiric Rôibeardescù shall represent at total of six seats, including two seats independent of party and four seats of The League of Centre Conservatives (LCC)

@Ián Tamorán shall represent the four seats of the Free Democrats of Talossa (FD) party

I, @X. Pol Briga shall represent the four seats of the Balançeu/Balance (BAL) Party

@Ián S.G. Txaglh shall represent two seats independent of party (IND)

Two seats voted as LA CORAZIUN SîNGICîNDS shall remain vacant, as no person has made a claim to this party

Thus in effect there will be up to 16 active seats and a total of 4 vacant seats based upon the dictates of CAG Chapter II Article 9.  As per CAG Chapter II Article 10, the requirements to pass any conventional bill into law will thus require 9 of 16 votes, which is achieveable in some cases with the votes of the LCC plus either the FD or BAL for a total of 10, or a combination of the FD, BAL, and IND for a total of 10.  In order to alter the CAG, the requirement shall be 11 votes (as per CAG Chapter VIII - Article 21) and thus shall require the votes of the LCC and IND plus either the FD or BAL for a total of 12, or the LCC + FD + BAL for a total of 14.

Other citizens may suggest legislation, but each item brought before l'Etats shall require sponsorship by a seated member to read the proposal into the record for consideration.

As a first order of business I shall undertake to have a revised version of CAG with updates to Current holders of provincial offices (some of which may be vacant by inaction) and proposed revisions of various typographical errors on or before 10 December 2020 for consideration by the l'Etats under the requirements to alter the CAG and newly endorse Chapter IX Article 22 for the current time.  Other bills should be placed in this forum for consideration on or before 10 December 2020 for consideration and voting on or before 20 December 2020 (exceeding the 7 day minimum set in CAG Chapter II Article 10) with a subject line "l'Etats Session 1: NAME OF PROPOSAL" where NAME OF PROPOSAL is replaced by an appropriate title, and the body of the proposal is contained within the forum post, allowing for discussion.  On or before 10 December, all proposals that become sponsored by a seated member will be combined into a single subject "l'Etats VOTING THREAD SESSION 1", first considering amendments to the CAG, then other bills.

If anyone has issues with this proposed order of business please place comments in this thread, or if you are a seated member and agree to this order of business please affirm in this thread as well.
