[CRL] The Charitable PermSec Act

Whereas, there has been recognition of the need to make better use of the Civil Service to open up space for apolitical activity, and

Whereas, it has been revealed that the Administrator of the Bureau of Humanitarian Aid and International Development is considered a political position, and

Whereas, the bill author assumes the executive for an agency charged with humanitarian aid and international development for the Kingdom of Talossa is a position ripe for transformation from the political arena to the Civil Service.

Therefore, be it resolved that the following amendments in el Lexhatx are enacted by the Ziu:

Section D2.6.6 which reads as follows:

Quote2.6.6 The Bureau for Humanitarian Aid and International Development (The Bureau) shall serve as the hub for the Kingdom of Talossa's support for disaster and poverty relief and other forms of humanitarian assistance, emergency response and the promotion of efforts towards socioeconomic development.
2.6.6.1 The Bureau shall operate under the auspices of the Ministry of Foreign Affairs. The Bureau shall be administered by an Administrator to be appointed by the Minister of Foreign Affairs.
2.6.6.2 The Bureau shall be funded by contributions from individuals, nonprofit organizations and where deemed appropriate by the Ziu, legislative appropriations.
2.6.6.3 The Administrator shall make every effort to ensure that Bureau's funds are donated to humanitarian organizations in a timely manner, and shall notify the public when outgoing donations are made. This notice shall include at least the amount, date, and beneficiary of the outgoing donation(s).
2.6.6.3.1 Other provisions of el Lexhatx notwithstanding, outgoing donations made with money contributed by private parties shall not require the approval of the Ziu.

is deleted in its entirety.

A new sub-section is added immediately following 1.7 to Section C of el Lexhatx, as follows:

Quote1.8 The Office for Humanitarian Aid and International Development (The Office) shall serve as the hub for the Kingdom of Talossa's support for disaster and poverty relief and other forms of humanitarian assistance, emergency response and the promotion of efforts towards socioeconomic development.
1.8.1 The Office shall operate under the auspices of the Royal Civil Service. The Office shall be administered by a Permanent Secretary for Humanitarian Aid and International Development to be recommended by the Minister of Foreign Affairs for appointment by the Seneschal.
1.8.2 The Office shall be funded by contributions from individuals, nonprofit organizations and where deemed appropriate by the Ziu, legislative appropriations.
1.8.3 The Permanent Secretary for Humanitarian Aid and International Development shall make every effort to ensure that the Office's funds are donated to humanitarian organizations in a timely manner, and shall notify the public when outgoing donations are made. This notice shall include at least the amount, date, and beneficiary of the outgoing donation(s).
1.8.3.1 Other provisions of el Lexhatx notwithstanding, outgoing donations made with money contributed by private parties shall not require the approval of the Ziu.

Section C.2 of el Lexhatx which currently reads as follows:

With the exception of the Secretary of State and the Permanent Secretaries, every Office of the Royal Civil Service shall be assigned to a responsible Minister of the Government as named below, to report and consult concerning the conduct of their office as and when requested, necessary or useful. Officers are not subject to the direction of their responsible Minister except as required by Organic and statutory law. The Scribe of Abbavilla shall be responsible to the Attorney-General, the Royal Archivist to the STUFF Minister, the Burgermeister of Inland Revenue to the Minister of Finance, and the President of the Royal Society and the Poet Laureate to the Minister of Culture.

is amended to read as follows:

There's no need for a law for this. There is already a provision in the law for a minister to create a permanent secretary and ask for an appointment. That is what I suggest be done.

Thanks buddy. This moves the Bureau to the Civil Service as well and replaces the administrator position with the permanent secretary in law.

Again, there's no need for a law for this to happen. The minister can just announce the change, define the new office of a permanent secretary for the position, and ask for the appointment.

The Baron suggests a different route. Should the MinFor go that route then I will withdraw the bill, if not, then I will move this bill to the CRL.

The purpose of proposing this law is for the Opposition Leader to try to force the Government to do what he wants them to do. Which is weird because he knows it won't work.

I have no strong position at all on BHAID - I've often thought that Talossa runs the risk of turning into something like the Rotary Club for which "charity" is the primary motivation. The question of PermSec or political appointment is secondary to the question of the purpose of BHAID.

I don't think there's any real strategy here, just the usual instinct that leads people to assume that you need a law to do anything in Talossa (inter alia, of course... writing laws is also fun!)

As strategy, it doesn't make sense. The Government commands a majority of the Cosa, and so a bill to try to force the Government to do something is a little silly unless you think it's divisive enough to split their votes.  And this isn't a big enough matter to do that, even if you discount the fact that Breneir himself is personally not very popular among them.  Nor does it make sense to get on the record as an electoral issue.

So yeah, I think he was on the level.  For what it's worth, I think it does make sense to appoint him as Permanent Secretary for BHAID administration.  It's clearly been a topic of sincere interest for him for years, and he'd do a good job.

Thank you Baron. You've once again demonstrated your commitment to reason.
The Government has previously stated its desire to enhance the Civil Service for the purposes of creating more space for non-political activity opportunities. I agree with that effort.

In another thread, when I asked about the Administrator position I honestly assumed that it was treated more like a Civil Service type position (which is why I asked if I had been removed as the last Administrator) because that makes sense for a hopefuly apolitical issue like humanitarian aid. When you confirmed that it is considered a political position I viewed it within a shared interest to enhance the Civil Service and proposed the bill and asked the current Foreign Minister to co-sponsor. The whereas clauses say this, I hope.

The Baron suggested a different route which the Foreign Minister can choose to take. If not, then I propose a bill to achieve the same thing but either way I have assumed it would be a part of a broader effort on which we both agree.

He is correct that as the author of the bill founding the agency I am invested and take personally its success. My interest in the BHAID is equal to my concern for the office of Secretary of State but like my efforts on both I am not seeking an office from the current Government.
