And for comment by any other person as input to these elected officials, the following legislation is proposed:
A13 An Act to secure Homesteads on the Isle of Cézembre
Section 1: Be it enacted by the l'Etats de Cézembre assembled, That any person who is of Talossan or Berber heritage, or who has arrived at the age oftwenty-one eighteen years, and is a citizen of Talossa, or who shall have filed their declaration of intention to become such, as required by the naturalization laws of the Kingdom of Talossa, and who has never borne arms against the Kingdom of Cézembre or the Kingdom of Talossa or given aid and comfort to its enemies, shall, from and after Squirrel Appreciation Day, the twenty-first of January, two thousand and twenty-one, be entitled to a virtual area of three meters by three meters (hereinafter the "Core") as defined be three words as described at https://what3words.com/about-us/, in either the English or French Language, plus the eight 3m^2 areas immediately adjacent the core (hereinafter the core plus the additional 8 areas are the "Site"), from lands in Canton Zone Interdite, upon which said person has filed a written claim via the preferred form https://forms.gle/S4Ug6URD76CJk6jM8 or in the thread http://wittenberg.talossa.com/index.php?topic=636.msg5014#msg5014, or both. Any claims made only on the form will be be identified to appropriate threads for senior claim reference while keeping any personal contact information related to the claim confidential. The three words of the Core will be used to identify the Site area. An area of 16 3m^2 areas surrounding a claim are held as an Easement for egress (which may be shared between Sites). Exceptions to the Site area and Easement include when all senior claims established by date accept a junior claim that would otherwise impinge on one or more senior claims or easements, such that egress to each Site is preserved and a written distribution of 3m^2 areas are ascribed to specific Site claims such that no Site shall have more than nine 3m^2 areas, but may have less. As Cézembre has ready access to the sea, the sea in turn may be used as an Easement for egress.
Section 2. And be it further enacted, That the person applying for the benefit of this act shall, upon application to the register of the Cézembre Land Office [CLO] in which he or she is about to make such entry, make affidavit before the said register or receiver that he or she istwenty-one eighteen years or more of age, or shall have performed service in the army or navy of the Talossa, and that he has never borne arms against the Government of the the Kingdom of Cézembre or the Kingdom of Talossa or given aid and comfort to its enemies, and that such application is made for his or her exclusive use and benefit, and that said entry is made for the purpose of virtual settlement or occupancy, and not either directly or indirectly for the use or benefit of any other person or persons whomsoever; and upon filing the said affidavit with the register or receiver; Provided, however, That no certificate shall be given or patent issued therefor until the expiration of three months from the date of such entry ; and if, at the expiration of such time, or at any time within two years thereafter, the person making such entry ; or, if he or she be dead, their heirs or devisee; shall. prove by two credible witnesses that he, she, or they have virtually settled or occupied the same for the term of three months immediately succeeding the time of filing the affidavit aforesaid, and shall make affidavit that no part of said land has been alienated, and that he or has borne rue allegiance to Kingdom of Cézembre and the Kingdom of Talossa ; then, in such case, he, she, or they, if at that time a citizen of the Kingdom of Cézembre and/or the Kingdom of Talossa, shall be entitled to a patent, as in other cases provided for by law.
Section 3. And be it further enacted, That the register of the Cézembre land office shall note all such applications on the tract books and plats of that office, and keep a register of all such entries, together with the proof upon which they have been founded.
Section 4. And be it further enacted, That no lands acquired under the provisions of this act shall in any event become liable to the satisfaction of any debt or debts contracted prior to the issuing of the patent therefor, nor at any time in the future except in virual exchange within the context of the Kingdom of Talossa and the Kingdom of Cézembre.
Section 5. And be it further enacted, That if, at any time after the filing of the affidavit, as required in the second section of this act, and before the expiration of the three months aforesaid, it shall be proven, after due notice to the settler, to the satisfaction of the register of the land office, that the person having filed such affidavit shall have actually changed his or her residence, or abandoned the said land for more than six months at any time, then and in that event the land so entered shall revert to Cézembre.
Section 6. And be it further enacted, That no individual shall be permitted to acquire title to more than one core area under the provisions of this act; and that the Commissioner of the Cézembre Land Office is hereby required to prepare and issue such rules and regulations, consistent with this act, as shall be necessary and proper to carry its provisions into effect: Provided, That nothing contained in this act shall be so construed as to impair or interfere in any manner whatever with existing preemption rights : And provided, further, That all persons who may have filed their applications for a preemption right prior to the passage of this act, shall be entitled to all privileges of this act: Provided, further, That no person who has served, or may hereafter serve, for a period of not less than fourteen days in the army or navy of the Kingdom of Talossa and/or the Kingdom of Cézembre, either regular or volunteer, under the laws thereof, during the existence of an actual war, domestic or foreign, shall be deprived of the benefits of this act on account of not having attained the age oftwenty-one eighteen years.
Section 7. There shall be an original list of claims appended to this act as selected prior to Landmark Day - 18 January 2021 which is also Martin Luther King day in the USA, and is the day before Remembrance Day. Claims after that date will be appended to a list maintained by the CLO and shall be subject to the same rules of origination and easement. The public list shall mention only the name making the claim in Canton Interdite, the three words of the claim (in English or French or both) as placed within a directing URL, and any adjustments to site areas or easements previously agreed in writing by senior claims. The CLO shall maintain a private list of contact information (to be used by no other entity and no other purpose) for the issuance of certificates to claimants and other business related to management of the claims, sites, easements, and relationship to these lands in Canton Zone Intredite with . Cézembre government lands and appurtenances shall be in the Canton Zone Autorisée. Should the system What3Words cease, these claims will revert to other geographic coordinate definitions as can be determined by coordinate conversion.
